The TSB is an independent agency, created by an Act of Parliament (the Canadian Transportation Accident Investigation and Safety Board Act, that came into force on 29 March 1990. The TSB consists of up to five Board members, including a chairperson, and has approximately 220 employees. Our Head Office is located in Gatineau, Quebec; however, most investigation staff are located in various regional and field offices across Canada where they are better able to respond quickly to transportation occurrences anywhere in the country.
The Canadian Transportation Accident Investigation and Safety Board Act provides the legal framework that governs TSB activities. Our mandate is to advance transportation safety in the marine, pipeline, rail and air modes of transportation by conducting independent investigations, including public inquiries when necessary, into selected transportation occurrences in order to make findings as to their causes and contributing factors; identifying safety deficiencies, as evidenced by transportation occurrences; making recommendations designed to eliminate or reduce any such safety deficiencies; and reporting publicly on our investigations and on the findings in relation thereto. As part of its ongoing investigations, the TSB also reviews developments in transportation safety and identifies safety risks that it believes government and the transportation industry should address to reduce injury and loss. To instill confidence in the public regarding the transportation accident investigation process, it is essential that an investigating agency be independent and free from any conflicts of interest when investigating accidents, identifying safety deficiencies, and making safety recommendations. As such, the TSB is an independent agency, separate from other government agencies and departments, that reports to Parliament through the President of the Queen's Privy Council for Canada. Our independence enables us to be fully objective in making findings as to causes and contributing factors, and in making transportation safety recommendations.
La Loi sur le Bureau canadien d'enquête sur les accidents de transport et de la sécurité des transports établit les paramètres juridiques qui régissent les activités du BST. Notre mission consiste essentiellement à promouvoir la sécurité du transport maritime, ferroviaire et aérien, ainsi que du transport par pipeline : en procédant à des enquêtes indépendantes, y compris des enquêtes publiques au besoin, sur les accidents de transport choisis, afin d'en dégager les causes et les facteurs; en constatant les manquements à la sécurité mis en évidence par de tels accidents; en faisant des recommandations sur les moyens d'éliminer ou de réduire ces manquements; en publiant des rapports rendant compte de ses enquêtes et présentant les conclusions qu'il en tire. Dans le cadre de ses enquêtes, le BST procède également à l'examen des développements liés à la sécurité des transports et identifie les risques qu'il estime que le gouvernement et l'industrie des transports devraient tenir compte afin de réduire les blessures et les pertes. Pour favoriser la confiance du public à l'endroit du déroulement des enquêtes sur les accidents de transport, l'organisme d'enquête doit non seulement être objectif, indépendant et libre de tout conflit d'intérêts, mais aussi perçu comme tel. La principale caractéristique du BST est son indépendance. Le Bureau relève du Parlement par l'intermédiaire du président du Conseil privé de la Reine pour le Canada et il est indépendant des autres organismes gouvernementaux et des ministères. Notre indépendance assure la parfaite objectivité de nos constatations pour ce qui est des causes et des facteurs contributifs ainsi que de la formulation de recommandations en matière de sécurité des transports.
